1. Acceptance of Terms

By accessing or using GolfCartsList.com (the “Website”), including browsing listings, creating an account, posting content, or purchasing paid features, you agree to be bound by these Terms of Service (“Terms”).

If you do not agree with these Terms, you should not use the Website.

We may update these Terms from time to time. Your continued use of the Website after updates are posted constitutes acceptance of the revised Terms.

2. Eligibility and Responsible Use

The Website is generally accessible to visitors. However, creating an account, posting listings, purchasing paid services, or engaging in transactions is intended for individuals who are legally capable of entering into binding agreements.

By registering an account or engaging in transactions, you represent that you are legally permitted to do so under applicable law and that your use of the Website complies with all local, state, national, and international laws applicable to you.

3. Marketplace Role

GolfCartsList is an online platform that enables users to create, view, and respond to listings for golf carts, parts, accessories, and associated services.

Rampok Media, the operator of the Website, does not own, buy, sell, resell, inspect, store, transport, broker, or otherwise take possession of any items listed on the Website. The Website is not a party to any transaction between users.

All transactions conducted through or as a result of information obtained on the Website are solely between the participating users.

We do not guarantee the accuracy, completeness, safety, legality, quality, or condition of any listings, nor do we verify the identity, background, or representations of users.

While we may review reports of misconduct or policy violations, we are not obligated to investigate, mediate, resolve, or take action in response to every complaint. We reserve discretion in determining whether and how to respond to alleged violations of these Terms.

Users are solely responsible for evaluating listings, communicating with other users, conducting due diligence, and complying with applicable laws.

4. Transactions Between Users

Any agreement, negotiation, payment, delivery, or transfer of goods or services is solely between the users involved. The Website does not provide escrow services and does not guarantee performance by any party unless explicitly stated otherwise.

Users assume full responsibility for their interactions and transactions. The Website is not responsible for disputes, misrepresentations, non-performance, product defects, or any loss or damage arising from user transactions.

Users are encouraged to exercise caution, verify information independently, and take appropriate safety measures when conducting transactions.

5. User Content and Listings

Users may submit listings, descriptions, images, reviews, messages, and other content to the Website (“User Content”). You retain ownership of your User Content; however, by submitting content, you grant Rampok Media a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify (for formatting or technical purposes), and distribute such content in connection with operating and promoting the Website.

By submitting User Content, you represent and warrant that you own the content or have all necessary rights and permissions to publish it, that it does not infringe upon the rights of any third party, and that any required attribution or licensing disclosures have been properly provided.

The Website does not independently verify the ownership, authenticity, or accuracy of User Content. We are not responsible for verifying whether images, descriptions, or branding references correspond to the actual item being offered or comply with intellectual property laws.

We reserve the right, but not the obligation, to review, edit, remove, or restrict User Content at our discretion.

6. Prohibited Activities

You agree not to use the Website in any unlawful, misleading, fraudulent, or abusive manner. This includes posting false or deceptive listings, misrepresenting your identity, offering items you do not have the legal right to sell, infringing intellectual property rights, manipulating listings or reviews, circumventing applicable fees, sending spam or harassing communications, interfering with Website security, or accessing, collecting, scraping, extracting, or using data through automated or unauthorized means.

We reserve the right to suspend or terminate accounts and remove listings in response to violations of these Terms.

7. Fees and Payments

Certain features of the Website may be offered for a fee, including paid listings, promotional placements, subscription plans, or other enhanced services. All applicable fees will be disclosed at the time of purchase.

By purchasing a paid feature or subscription, you authorize the selected payment provider to process the transaction. Unless otherwise stated, fees are non-refundable once activated.

The operator of the Website, Rampok Media, reserves the right to modify pricing or features at any time. Changes will apply prospectively and will not affect paid services already activated before the effective date of the change.

The Website does not guarantee specific results, visibility levels, sales outcomes, or user engagement.

8. Disclaimer of Warranties

The Website and all content and services are provided on an “as is” and “as available” basis.

Rampok Media makes no warranties, express or implied, regarding the operation of the Website, the accuracy of listings, service availability, or transaction outcomes.

To the fullest extent permitted by law, all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.

We do not warrant that the Website will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Rampok Media shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Website.

In no event shall total liability exceed the greater of (a) the total amount paid by you to the Website in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Rampok Media and its affiliates from any claims, liabilities, damages, losses, costs, or expenses arising out of your use of the Website, your User Content, your transactions, or your violation of these Terms or applicable law.
